Terms & Conditions

Acceptance of Terms

Welcome to Napesa. By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Napesa Africa Ltd ("we," "us," or "our") regarding your use of the App. Please read them carefully.

Service Description

Napesa is a personal finance management application that helps users track their spending, create budgets, and gain insights into their financial habits. The App transmits financial SMS messages to our servers for processing to automatically categorize transactions and provide financial analytics. Note that processing does not happen on the device.

Key features of our service include:

  • Automatic transaction tracking from SMS messages
  • Budget creation and management
  • Spending analytics and insights
  • Receipt scanning (OCR) for expense tracking
  • AI-powered financial advice

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

User Responsibilities

As a user of Napesa, you agree to:

  • Provide accurate and complete information when using the App
  • Maintain the security of your device and prevent unauthorized access to the App
  • Use the App only for lawful purposes and in accordance with these Terms
  • Not attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of the App
  • Not use the App in any way that could damage, disable, overburden, or impair our servers or networks
  • Not use any automated means to access the App or collect any information from the App
  • Comply with all applicable laws and regulations while using the App

Account, Login, Security

To use certain features of the App, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to terminate or suspend your account at any time if we believe you have violated these Terms or for any other reason at our sole discretion.

Subscription Plans

Napesa offers both free and premium subscription plans. By subscribing to a premium plan, you agree to the following:

Free Trial Policy

We may offer a free trial period for our premium features. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends. You will not receive a notice that your free trial has ended or that your paid subscription has begun.

Billing

Payment for premium subscriptions will be charged to your selected payment method at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Refund Policy

We offer refunds within 7 days of initial purchase if you are not satisfied with our premium service. To request a refund, please contact us at team@napesa.africa with your purchase details. After the 7-day period, subscriptions cannot be refunded for the current billing cycle but can be canceled for future cycles.

Data Ownership

All data, both raw and computed, that is processed or generated through your use of the App belongs to you, the user. This includes:

  • SMS data processed by the App
  • Transaction records and categorizations
  • Budget information and financial goals
  • Insights and analytics generated from your data

Users can delete all their data if they wish through the app settings. When you delete your data, all information stored on our servers is permanently deleted, except for anonymized statistical data that cannot be linked back to you.

While you retain ownership of your data, you acknowledge and agree that your data cannot be used to claim any payments, income, or financial compensation from Napesa Africa Ltd. The services provided by the App are subject to the subscription plans outlined in these Terms, and ownership of your data does not entitle you to any additional compensation or revenue sharing from Napesa Africa Ltd.

Furthermore, you agree that you can never claim any benefits, either in terms of money, financial or otherwise, on the premise of your data being used to train models or optimize our services. This includes but is not limited to any claims related to improvements in the App's functionality, accuracy of categorization, or any other enhancements that may result from the use of your data for training or optimization purposes.

Limitations & Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that:

  • The App will always be available, uninterrupted, or error-free
  • Any errors in the App will be corrected
  • The App is free of viruses or other harmful components
  • The results of using the App will meet your requirements

Financial Advice Disclaimer: The financial insights and recommendations provided by the App are for informational purposes only and should not be considered professional financial advice. You should consult with a qualified financial advisor before making any significant financial decisions.

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or in connection with your use of the App.

Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by:

  • Posting the updated Terms on our website
  • Sending an in-app notification
  • Updating the "Last Updated" date at the bottom of these Terms

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you should stop using the App.
